What triggered me for the review was the 60 days of notice rule and the very interesting, unexpected answer received. We didn’t aware that for staying on original contract, it was still required to have 60 days of notice. We received letter for options of letting us extend our lease and the due day was Feb. 15th. We thought that we would be good to response till that day. Then on End of January, we received email that out apartment will be converted to month to month. That was strange since the default should be staying on the original contract to move out. We went to the office on Feb 1st to ask and advised that we were still on time for given notice and move out on original date of 3/26. Therefore we signed the paper work for the notice. Then, for March rent we were charged the additional month to month rate beyond 03/26. We asked why and they were unable to find the notice that both ends signed. Fortunately, we had our copy and provided. Then they say that from Feb. 1 to March 26 there were not enough 60 days (Noticed here the contradiction of the response due day of Feb.15th and the 60 days of notice rule). They will still need to charge us the money to cover from 3/26 to 3/31 for making up of 60 days. We paid that money of no arguing. And moved out on 3/24 since we planned everything already. On final bill, we received insufficient notice penalty charge. It was a small amount but we feel like that we need to ask. We paid additional to have bought the time, which we may refuse since both of us signed the document. If we had a mistake of not fully clear the rule, then how about their people? And the new signed document should overwrite the original. Either we be given refund for the additional days charged or there should not have any insufficient notice penalty. Then here comes the response of the assistant manager Tracy Guess after asked the question for over a week: “In regards to the insufficient notice penalty: this does not mean that you gave insufficient notice, only that you handed in keys early.” Hardly for me to understand her logic and feel necessary to shared online to all of you for you to be aware of and have your own decision. In additional to that the apartment was declared cleaned and ready but I used 21 cans of detergent for deep cleaning myself at the initial moving in since I can not tolerant the dark and odor of the old carpet and can not wait for them especially on the odor (see photos, that was after my deep cleaning that not able to make any better).
